Fake Made in Italy: Chianti continues to win in Europe

The court once again affirms the reputation and distinctive character of the Black Rooster symbol

In September 2017 a company in Rome requested the registration in class 33 (wines) of a trademark with an image similar to that of the Gallo Nero trademark. The Chianti Classico Wine Consortium immediately opposes the protection of the historic trademark of the appellation, and in 2020 the Appeals Commission of the Trademark Office accepts the consortium's opposition. Nevertheless, the proceeding continues before the EU Court which today confirms the rejection of the proposed trademark, strongly reiterating that the use of a sign that can be confused with the Black Rooster represents a serious risk of undue advantage and exploitation "of the high notoriety, prestige and the excellence projected by the Gallo Nero brand", the unique symbol of the Chianti Classico DOCG wine.

This is not the first victory of the Chianti Classico Wine Consortium in the field of legal protection of the brand. In fact, the European courts have already affirmed this principle of protection of the Black Rooster on several occasions, and 61 times in the last 15 years the trademark offices around the world have recognized the principle now so clearly expressed by the European court.

Says the president of the consortium, Giovanni Manetti : “We applaud the ruling of the European court which makes us even more aware of the communicative power of our figurative brand, but above all of the excellence that our name represents in the world. At this moment I ideally thank the 33 winegrowers who in 1924 decided to identify such a powerful figurative mark as a symbol of the denomination. Long live the Chianti Classico”.
